32. Graves6 EAVES , 4th (313)XE "Eaves:Graves , 4th (313) (b. circa

):(--?--) (1182) (b. circa 1772, d. after 1803)" circa 1810 in GA. Biography
by James M. Eaves, 3rd great-grandson.
Graves Eaves, IV was born in Rutherford County, NC, about 1786. His
father was Bartlett Yancy Eaves, I and his mother was Charity Berryman
Lewis.
The EAVES family were on the move, looking for land. Jonathan Eves
came to Virginia, from England, in 1636. William Eves moved to Tyron
County, NC by 1774. In 1778 the name was changed to Lincoln and Tyron
was subdivided into Rutherford(1779), McDowell (1842), Burke (1777),
Catawa (1842), Lincoln (1778), Gaston (1846) and Cleveland (1841).
Bartlett Yancy Eaves, I and his sons, Graves Eaves, IV, Abel Lewis Eaves,
Bartlett Y. Eaves, II Howard H. Eaves, Burrell Eaves and Jessie B. Eaves, I
moved to GA after 1800. They were in Clark County and Jasper County,
GA.in the early 1800s.
In 1812 Graves bought land in Clark County from Isaac Suttle. The Suttle
family was also in Rutherford County, NC when the Eaves lived there.
Graves' wife, Margaret was probably a Suttle, but no proof has been found.
Graves probably married Margaret in Elbert or Clark County, GA about
1809-1810. Their first child, Jesse B. Eaves was born in GA in 1811.
The Eaves family left GA and moved to AL sometime before 1819. Graves
Eaves IV is listed as a Delegate to the Cahawba Baptist Association in
October 1820, with Isaac Suttle, from Rebobeth Church in Cahawba (Bibb)
County, AL. The Rehobeth Baptist Church was admitted to the Cahawba
Baptist association in 1819. There is also an undated record of the male
membership of the Concord Baptist Church, near Mooresboro, NC, that
lists Graves Eaves, Bartlett Eaves, Abel Lewis Eaves and William Lewis as
members. The church was organized 14 Oct 1804, with 31 members.
Graves' second son, Isaac S. Eaves was born in GA in 1813. Another son,
Graves P. Eaves, was born in 1819, the year AL was admitted as a state and
the year Perry County was created. His son's middle name is commonly
given as 'Perry'.
The 1830 Census of Perry County,AL lists Bartlett, Graves IV, Burrell,
Howard H. and Jesse B. Eaves. Graves and Bartlett are on sheet 62, Burell
on sheet 47, Jess B. on sheet 61 and Howard on sheet 71. Another Jesse B.
Eaves is listed in Marengo County in 1830. This was probably the son of
Jesse B. Eaves Sr. Graves lived about 6 miles south of the present town of
Uniontown, Perry, AL and was listed as owning 3 slaves.
Graves died in 1836, before October, without a will and his estate records
are in the Perry County Probate and Orphans Court Records. See the
Minutes of the Orphans Court, Book 'B', 1832-1838, page 275, October
Term 1836. Jesse B. Eaves and Issac S. Eaves, sons of Graves were
appointed Administrators of the estate of the late Graves Eaves. Action;
Approved, Filed and Recorded. He lived in Perry County,AL, about 6 miles
south of Uniontown,AL, in 1836 and is probably buried nearby. He owned
at least 280 acres of land consisting of the NE/4 of the SW/4 of Section 8,
the NE/4 of the SW/4 of Section 8 and the SE/4 of Section 8, all in
Township 16N, Range 6E in the county of Perry.AL.(See Perry County
Deed Record Book F Page 506, Dec 13, 1841)
At the time Graves died two children, Harman S. Eaves and Edithry A.
Eaves were minors. Isaac S. Eaves was appointed guardian of Harman S.
Eaves and Jesse B. Eaves was appointed guardian of Edithry A. Eaves. The
estate was not settled until 1841 and in the meantime Jesse B. Eaves
married Matha Bailiff. Elizabeth Eaves married Jabez J. Osbourn and
Margaret Suttle Eaves, widow of Graves, married Robert Bailiff. The final
distribution of the land of Graves Eaves took place in December 1841 (See
Deed Record Book 'F', P-506, 13 Dec 1841) and the parties signing the
indenture were, Jesse B. Eaves, Isaac S. Eaves, John H. Eaves, Graves P.
Eaves, and Jabez J. Osbourn, representing his wife, Elizabeth Ann Eaves.
There is some confusion about the name of Graves Eaves. Early
researchers list him as Graves P. Eaves. None of the documents found in
the Perry County Probate or Orphans Court records show him as Graves P.
Eaves and his son, Graves P(erry) Eaves is not listed as a Junior. This
researcher(JME) believes the middle initial P. stands for Perry because the
son, Graves P. was born in 1819, when Perry County came into being.

64. Bartlett Yancy7 EAVES 1st (333)XE "Eaves:Bartlett Yancy 1st (333)
(b. circa 1765, d. after 1831)" was born circa 1765 in Granville Co., NC. He
married Charity Berryman LEWIS (488)XE "Lewis:Charity Berryman

(7227),XE "Berryman:Charrity (7227) (b. circa 1751, )" circa 1783 in
Rutherford, NC. He died after 1831 in Perry Co., AL. Biography by James
M. Eaves, 4th great-grandson.
The 1800 census of Rutherford Co,NC shows Bartlett Eaves as head of a
household, with 5 sons and 2 daughters. Bartlett Yancy Eaves may have
been born in Brunswick Co, VA. Before 1809 he left had NC and was in
GA. His son, Graves, purchased land from Isaac Suttle in Clark Co, GA
Other records; (1.) A deed, dated June 8, 1809, recorded March 15, 1811
and filed November 13, 1811 in Randolph Co(later changed to Jasper
Co.),GA. shows that Bartlett Eaves, Millwright, had bought land from
Thomas Robinson. (Note)Thomas Robinson was in Rutherford Co, NC as
proved by a deed dated 1803 that shows him as a chain bearer for the crew
that surveyed land which Bartlett Eaves was purchasing.Evidently he had
gone on to GA and purchased land before 1809.
(2). A deed which shows Thomas Davis signed over a lease to Graves
Eaves on October 15, 1811 for value received. Dated October 15, 1811,
recorded January 17, 1812. Witnessed by Cornelius Autrey and Able Lewis
Eaves. This is in Jasper Co, GA Deed Book 5, page 59. (Note 1: Cornelius
Autrey was the son-in-law of Bartlett Eaves, his wife Nancy Eaves Autrey
died of snake bite before the family left NC). (Note 2: Cornelius Autrey
was the brother-in-law of Graves and Abel Lewis Eaves).
(3) Military records show that Bartlett, Howard and Burrell Eaves were
soldiers in the war of 1812. The record lists Bartlett and Howard, but there
is only a notation of Burell's participation.
From these records there were five young men named Eaves in Jasper Co,
GA in 1811 and 1812:
(1) Bartlett 1st, (2) Graves, (3) Abel Lewis, (4) Howard (5) Burrell,
2,3,4 & 5 were probably the sons of Bartlett 1st
There is no 1820 census record for Perry Co, AL, but the 1830 census
shows: (1) Bartlett Eaves I, age 60-70 (2) Graves Eaves IV, age 40-50 (3)
Burrell Eaves, age 30-40 (4) Howard Harvey Eaves, age 40-50
The 1830 census for Marengo Co,AL shows: (1) Abel Lewis Eaves, age
40-50 (2) Bartlett Eaves2nd, age 30-40 (3) Jesse B. Eaves 2nd, age 20-
30(Note: Records from the Perry County Orhpans Court show the Jesse
Eaves listed here is the son of Graves Eaves 4th. He was born in 1810-
1811. There was another Jesse B. Eaves, son of Burrell, who is not shown
on this census).
The 1830 Census of Perry County,AL, lists Bartlett Eaves, 1 male to 5, 1
male 10-15, 1 male 60-70, 1 female 15-20 years old.
Bartlett may also have married Nancy Elizabeth Thompson. Bartlett 1st
does not appear on the 1840 census record of Perry Co,AL. We have no
further records of him, but assume he died there.
Howard Harvey Eaves appears on the 1840 census of Marengo Co, ,but by
1850 he was in Pontotoc Co,MS. The other four, Able Lewis, Bartlett II,
Burrell and Jesse Berryman were in Texas by 1835, where all of them
received land grants from the 'Republic of Texas'. Copies of those of Abel
Lewis and Bartlett are included here. Whether or not they ever lived on
these grants is not known.
Jesse Berryman and Burrell settled on a bluff above the Neches River in the
vicinity of the present town of Beaumont, TX.(Ref: (1) The Texas Gulf
Historical and Biographical Record, November 1983,Vol XIX, No. 1.
Published by The Texas Gulf Historical Society, P.O. Box 1621, Beaumont,
TX 77704. (2) A letter written in 1893 by Noah Hampton Eaves, and in the
possesion of Betty Poulson, Tuscon, AZ , shows that Jesse Berryman and
Burrell were brothers.
By 1840 Abel Lewis, Bartlett and Jesse Berryman had come back across the
Sabine River to LA. The family legend is, that during the Texas Revolution
they feared for the safety of their families and brought them to an area not
involved in the war. Abel Lewis settled in Natchitoches(now Sabine)
Parish. Bartlett settled in Calcasieu(now Beauregard), Jesse settled in
Calcasieu(now Cameron). If Burrell ever came back to LA, he later
returned to TX and settled in San Augustine Co.
Burell Eaves received a land grant to more than 4000 acres in Williamson
County, TX, near the present site of Georgetown. The land is shown on a
plat of the county.

living in 1800 in Rutherford Co, NC. She probably died in TN about 1820.
Graves probably died in TN about 1830, he does not show on Rutherford
Co census after 1800. MARTHA YANCY EAVES daughter of Robert
Yancy and Temperance Yancy of Hanover, VA.
Listed in 1800 U.S. Census with Graves were: ANDREW, SOLOMAN,
DAVID, BUCKNER, and BARTLETT. 1830 U.S. Census of Perry Co, AL.
GRAVES, BURRELL, BARTLETT, and HOWARD EAVES.
Notes from Lewis Wyman Griffin, Jr., dated 18 Nov 1991 Graves EAVES
2nd was the son of Graves EAVES1st. He was born in Northumberland Co,
CA around 1720. By 1727 his family had moved to Brunswick Co,VA. In
November 1747, Graves and his brother Thomas sold their father's 100 acre
plantation on the north side of the Meherrin River, which they had inherited
a year before, to John Freeman for 30 English Pounds. Witnesses included
James Clack and Peter Tatum. Leanna (or Eleanor), wife of Thomas and
Sarah, wife of Graves, both relinquished their dower rights in this land (
Brunswick Co, VA Deed Book 3-365). (Some have thought that Graves
EAVES married a Nancy YANCY about 1750. Note however that his wife's
name was Sarah in 1747. No proof of a YANCY marriage has ever been
found).
Graves probably moved from Brunswick Co, VA to North Carolina shortly
after 1747 as there is no further record of him in Brunswick or nearby VA
counties. There is no evidence that he ever lived in Granville Co, NC,
although his son William's father-in-law, Andrew Hampton, had come to
Rutherford Co from there. Graves probably moved into the area that
became Rutherford Co at a very early date and simply neglected to take out
a patent on his land until much later. His first patent, in February 1775, was
for 109 acres in Tryon Co on the east side of the Second Broad River and
incuded 'EAVES' own improvement', suggesting he had been there for some
period of time. The land was adjacent to land of Robeson and Cathey
(Patent Book 26, #9058).Tyron Co was formed in 1768 from Mecklenburg
Co, which was formed in 1762 from Anson Co. A Graves EAVES is
mentioned in at least nine deeds in Rutherford Co. There may have been
more than one man with that name. Note that Graves EAVES born around
1720 would have been between 60 and 80 years old during the period
covered by these deeds.
In 1783, a Graves EAVES bought 200 acres on both sides of Puzzle Creek
from Thomas Roberson (DB A-D, p.107) In 1785 he sold 109 acres near
Roberson to Abel Lewis, with Burrell EAVES and Thomas Davis as
witnesses ( DB A-D, p.472) In 1787 he was granted 100 acres on Puzzle
Creek, 'beginning at his own corner' (DB M-Q, p.265). In 1792 he sold 75
acres of the land he had purchased in 1783 to Davis EAVES, 'adjoining his
own spring branch' ( DB M-Q, p.501). In 1798 he sold another 75 acres of
the 1783 purchase to William Baxter, 'adjoining Davis EAVES' (DB 12-14,
p.295). In 1799, Thomas Bryant sold ten acres to Davis EAVES, 'on Puzzle
Creek....beginning on Burrell EAVES line, to Graves EAVES line....(DB
15-17, p.77). Later in 1799, Graves sold 100 acres on his spring branch to
Sterling Price. Witnesses were Davis and Thomas EAVES, and Abel
LEWIS ( DB 20-21, p.74).
Graves EAVES was on the 1800 Census in Rutherford Co, but was not
there in 1810. Presumably he died before 1810. A deed made in 1817
mentions 'Graves EAVES' corner' (DB 32, p.14), but this does not
necessarilly imply that Graves was living at that time, as such language was
often copied from earlier deeds. No estate records have been found, and the
names of Graves children have been the subject of much speculation. That
Bartlett EAVES was a son of Graves is said to be proven by a Rutherford
Co court document dated 1758 which states that Graves EAVES went to
court to prove that his son' Bartley' was under the age of 21 and therefore
his tax money should be returned to him. (Notes from EAVES FAMILY
Reunion, 1980). That William and Burrell EAVES were brothers of Bartlett
is proven by a letter written in 1893 by William's grandson, Noah Hampton
EAVES. He states that William ' had two brothers, Bartlett and Burrell, one
sister who died from a snake bite when about 18 years old.'( Copy of this
letter is in the possession of Betty Poulson, Burbank, CA). Abstract of letter

William is accepted as the son of Jon(athan) Eves of England and Virginia.
No documentary proof of the relationship has been found, but the time
frame is right and both were in the right area.
William was probably married more than one time since he seemed to have
more than one set of children. One of the older children, Ralph, left an
estate to his brother, Thomas.
William Eves is listed in the Virginia Colonial Abstracts, Vol XIX,
Northumbria Collectanea 1645-1720, Abstracted by Beverly Fleet,
Baltimore Publishing Co. 1961, page 45 as follows; Eves, William.

It was not customary to 'bind' a child to a family member by an
apprenticeship indenture. The book on Northumberland apprenticeships
also shows Richard Nutt took on another apprentice in the same time period
(p. 15, item 60).
* The above information contradicts the accepted belief by some Eaves
descendants that Mary was bound to a brother, Richard, and unless some
other records exists to prove William had a son named Richard, he should
not be listed as a child of William.
William's estate was probated in Northumberland Co, VA in 1688-89. He
left a will, but the courthouse burned down between the time he made the
will and it was probated. The probate record was preserved and is now over
300 years old. No records have been found of William's wife or wives, but
he probably had a second wife whose name was GRAVES and was the
mother of Graves and Mary. Later records show the Eaves followed the
custom of naming a son with the surname (maiden name) of the wife. There
were many Graves Eaves in the family.

Jon(athan) Eves came to America with a group sponsored by Henry
Southell/Southworth. They landed in 1636 at Lyn Haven, on the 'Chesopean
Shore', in what was then Chickacoan Indian Territory, Virginia Colony. This
area was included in Northumberland County Virginia when it was formed
in 1648.

England d: 1660-1688 in Northumberland County, Virginia. The name of
his wife is not known, but she was probably from the Virginia Colony and
b: ca 1620 in England m: ca 1638 in Northumberland County, Virginia.
Jonathan is assumed to be the father of William Eves by at least two
certified genealogists. It is believed that William was born in 1640 in
Chickcoan Indian Territory, in Virginia Colony.
